These general conditions of sale are concluded between, on the one hand,
Koka the shop whose head office is located at 395 avenue du Touring Club in 40150 Soorts-Hossegor
Registered in the Dax trade and companies register under number SIREN 827 999 129 and whose intra-community VAT number is: FR 59827999129.
and, on the other hand, any adult wishing to make a purchase through the e-commerce site of Koka la boutique https://www.kokalaboutique.com/ , exclusive property of Koka la boutique.

Article 1: object
These conditions govern the sale of any product presented on the site https://www.kokalaboutique.com/ by Koka la boutique. They aim to define the reciprocal obligations of the parties as well as the different stages of the ordering process.
Koka la boutique reserves the right to modify the T&Cs at any time by publishing a new version of them on the site. The GCS applicable to the Customer are those in force on the day of his order on the site (i.e. at the time of signing the contract).
The site is free to access and free to any Customer. The acquisition of a product supposes the acceptance, by the Customer, of the entirety of the present GCS, which recognizes by the same fact to have taken full knowledge of it. The acceptance of these GCS may for example consist of the Customer checking the box corresponding to the sentence of acceptance of these GCS, having for example the mention "I acknowledge having read and accepted the general conditions of sale of this site" .
Article 2: Articles and products
The articles visible on the site https://www.kokalaboutique.com/ are only available within the limits of available stocks. If the product is not available, Koka la boutique undertakes to inform the Customer as soon as possible by e-mail or telephone. The Customer will then have the option of choosing another item or canceling his order and being reimbursed.
Any customer complaint regarding the order or delivery of an unavailable item will be considered unfounded.
Article 3: Price
The prices indicated on the site https://www.kokalaboutique.com/ are in euros all taxes included (TTC), VAT included and other taxes applicable on the day of the order. VAT is applied at the rate in force in mainland France at the time of the order. Any rate change would be applied immediately to the current order.
The prices of the products are exclusive of shipping costs, which are extra depending on the amount of your order. These will be brought to the attention of the buyer in his basket before the final validation of the order.
However, the establishment of the order depends on the geographical area of delivery:
- For deliveries in mainland France, the order will be established including tax.
Koka la boutique reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of the validation of the order and subject to availability.
The products remain the property of Koka la boutique until full payment of the price.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.
Article 4: Order Process
The Customer who wishes to place an order on the site https://www.kokalaboutique.com/ must follow the following procedure:
- The customer selects the product he wishes to order
- The customer checks the contents of his basket
- The customer must identify himself if he already has a customer account or create one by indicating the requested information (surname, first name, email and password)
- The customer checks the contents of his order, the total price, indicates a delivery and billing address. He then chooses a method of payment and must accept these T&Cs by ticking the corresponding box.
- The customer will then receive an e-mail summarizing his order.
We advise you to keep this document which is the official proof of your order.
The order is then recorded and processed by Koka la boutique. Koka la boutique undertakes to honor orders received on its website only within the limits of available stocks. In case of unavailability of the products ordered, Koka la boutique will contact the customer by e-mail as soon as possible, in order to prevent the cancellation or the refund of the order.
Finally you will receive an e-mail confirming the shipment of the product as well as the number to track the package.
Article 5: Method of Payment
The customer has the possibility of paying via a single means for his order made on our website:
- Payment by credit card with Stripe
The amount of the invoice will be debited from the customer's account on the date of payment. Koka la boutique will not send any products until the payment method has been validated.
Article 6: Delivery
The products offered for sale on https://www.kokalaboutique.com/ are only available in mainland France or in certain European countries. They will be delivered to the delivery address that the customer has indicated during the ordering process or to the DPD Relais pick-up point chosen by the customer.
For all products, the order is prepared in our shop and shipped within 1 to 2 working days (subject to product availability) from the confirmation of the order by e-mail.
For home delivery, the service is provided by the carrier DPD. The product is then delivered to the Customer's home.
For delivery to a collection point, the service is provided by the carrier DPD Relais (service provided by the DPD). The product is then delivered to the collection point chosen by the customer when ordering.
The customer can also withdraw his order in store via Click & Collect.
Deliveries in metropolitan France are invoiced with French VAT.
The deadlines announced on the site are purely indicative and depend on the destination and the availability of the product ordered. Exceeding this period cannot give rise to any order cancellation, to any reduction in the price paid by the buyer, and to any payment for damages. However, and in accordance with the provisions of article L.121-20-3 of the Consumer Code, for lack of delivery at the end of a period of thirty days from the following day on which the customer placed his order, the customer will have the possibility of canceling his order free of charge. The sums he has paid will then be refunded to him.
Article 7: Right of withdrawal
In accordance with the provisions of article L.121-21 of the Consumer Code, the customer has a period of 14 days to exercise his right of withdrawal. Within 14 days following the day of receipt of the ordered product, the Customer may exercise his right of withdrawal without having to justify reasons. The customer may thus request a refund of the item(s) purchased.
Beyond the 14-day period, Koka la boutique will be free to refuse the credit or refund the items purchased.
Conditions of the right of withdrawal and procedures to follow:
- The Customer must inform Koka la boutique of his wish to withdraw within 14 days of receipt of his order. For this, the Customer must send an email recalling the number of his order, the returned product and the reason for the return.
- An acknowledgment and validation email will then be sent to the Customer.
- The products as well as the packaging and accessories must be returned in their original conditions. In the event of a missing item, Koka la boutique reserves the right to refuse the refund or reduce the amount thereof.

Article 8: Exchange
The exchange is for the same item of a different size or color if the amount is the same and within the limits of stock availability.
The exchange will be processed within a maximum period of 14 days from the date on which Koka la boutique is informed of the customer's decision to withdraw, provided that the products as well as the packaging and accessories must be returned. in their original conditions.
The costs of returning the product(s) to be exchanged are the responsibility of the customer.
Koka la boutique will bear the cost of re-shipping the product(s).
Article 9: Return and refund
If the customer opts for a refund, Koka la boutique will reimburse the customer for the price of the product(s) (or delivery costs) within a maximum period of 14 days from the date on which Koka la boutique is informed of the customer's decision. to withdraw, provided that the products as well as the packaging and accessories must be returned in their original conditions.
Reimbursement may be deferred until recovery of the products or proof of shipment of the products by the customer. The date chosen is that of the first of these events. The refund will be made using the same payment method used for the initial transaction. Reimbursement may also take the form of a credit note if the customer so requests.
The costs of returning the product(s) to be refunded are the responsibility of the customer.
For sale products, the return is possible and the refund is in the form of a credit note. Valid for 6 months
Article 10: Legal warranties
The products sold on the site https://www.kokalaboutique.com/ benefit from the legal guarantee of conformity provided for by articles 211-4 and following of the consumer code and the guarantee against hidden defects, provided for by articles 1641 et seq. of the Civil Code. These warranties cover hidden defects and visible defects from the date of delivery. In the event of non-compliance of a product sold, Koka la boutique may offer the Customer the free replacement of the product or the repair of the products recognized as defective without any other benefit or compensation.
Article 11: Liability
The products offered comply with the French legislation in force. The responsibility of the Koka la boutique brand cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.
Koka la boutique cannot be held responsible for the non-performance of the contract due to the occurrence of an event of force majeure or fortuitous situation. Regarding the products purchased, Koka la boutique will not incur any liability for any consequential damages as a result of the present, operating loss, loss of profit, damage or costs that may arise.
Furthermore, Koka la boutique cannot be held liable for damages resulting from improper use of the purchased product.
Finally, Koka la boutique cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.
Article 12: Intellectual property rights
All elements of this site are and remain the exclusive intellectual property of Koka la boutique.
Any total or partial reproduction, representation or use of the elements of the site whether software, visual, textual or sound is strictly prohibited and is similar to counterfeiting.
Article 13: Applicable law
The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
Any dispute relating to the execution of these GCS that has not found an amicable solution will be subject to the exclusive jurisdiction of the courts within the jurisdiction of the place of residence of the defendant.
